Republic Act. No. 11313, otherwise known as the “Safe Spaces Act” shall take effect on August 3, 2019.

The significant provisions of this law are as follows:

1. “Catcalling” or unwanted remarks made in public directed towards a person in the form of wolf-whistling and misogynistic, transphobic, homophobic and sexist slurs is now a crime.

2. Calling a person “bakla” or “tomboy”, “good morning Miss Beautiful”, whistling at an attractive woman, persistent requests for the mobile number of another, public masturbation or flashing of private parts, groping or “chancing”, and the persistent telling of sexual jokes that is unwanted and has threatened one’s sense of personal space and physical safety can hold a person liable for penalties ranging from a Fine of Php1,000-Php100,000 to as much as six (6) months imprisonment for repeated violation.

3. “Gender-based Online Sexual Harassment” involves the use of cellphones and computers to harass another. This includes cyberstalking and incessant messaging, uploading and sharing of messages, photos, voice or videos with sexual content, and impersonating the identity of another or posting lies about another to harm their reputation can hold a person liable to imprisonment of as much as four (4) years and two (2) months or a fine of Php100,000-500,000 or both.

4. “Stalking” is now a crime. It refers to conduct directed at a person involving the repeated visual or physical proximity or non-consensual communication that cause or will likely cause a person to fear for one’s own safety or to suffer emotional distress. Repeatedly taking photos of another may constitute as ‘stalking’.

5. This law is in effect in the workplace. It may be committed by employees of equal rank, by a subordinate to a superior, by a student to a teacher, and by a trainee to a trainer. Employers have the duty to provide measures (e.g. anti-sexual harassment seminars) to prevent gender-based sexual harassment in the workplace, and the DOLE/CSC shall conduct yearly spontaneous inspections to ensure compliance by employers of their obligations under the law.

6. This law is in effect in schools. Every school must adopt and publish grievance procedures to facilitate the filing of complaints by students and faculty members. The school is obligated to investigate a possible act of gender-based sexual harassment even if the victim does not want to file a complaint, and must take immediate action to eliminate the same acts, prevent their recurrence and address their effects. School heads may be held liable for non-action.

7. The penalties for Public Space or Online Sexual Harassment increases by one degree, meaning, to as much as eight (8) years imprisonment, if: (a) the offender is the driver of a PUV and the victim is a passenger; (b) the victim is a minor, a senior citizen, a PWD or a breastfeeding mother nursing a child; and (c) if the offender is a member of the AFP or PNP, and the sexual harassment was done while he was in uniform.

8. “Public Spaces” include public streets, parks, schools, malls, bars, and public utility vehicles including GRAB cars.

9. Sexual harassment done by the driver of a public utility vehicle may result in the revocation of the franchise of the company, and may make the owner solidarily liable with the driver.

The Supreme Court en banc reiterated in A.M. No. 18-03-16-SC or the Adoption of the Plea Bargaining Framework in Drug Cases, guiding judges on the offenses falling under acceptable plea bargain agreement.

The Court, in separate resolutions in A.M. No. 18-03-16-SC issued in 2018 and 2019, held, among others, that plea bargaining in drugs cases is allowed and probation may be availed of only in the following instances:

1. When the accused is charged with possession of dangerous drugs under Section 11 of RA 9165 and the quantity of “shabu” is less than 5 grams or in case of marijuana, it is less than 300 grams.

2. When the accused is charged under Section 5 of RA 9165 with the sale of “shabu” and the quantity found in his/her possession is less than 1 gram; or if marijuana only, it is less than 10 grams.

3. When the accused is charged under Section 13 (Possession of Dangerous Drugs During Parties, Social Gatherings or Meetings) in relation to Section 11 of RA 9165 and the quantity of the dangerous drug in his/her possession is less than 5 grams; or in case it is marijuana, the quantity is less than 300 grams.

4. When the accused is an employee or a visitor of a drug den, dive or resort provided that he/she is charged solely under Section 7 of RA 9165, and there is no other person charged for maintaining the said drug den, dive, or resort.

Plea Bargaining is also allowed when an accused is charged with possession of “shabu” weighing 5 to 9.99 grams; or of marijuana weighing 300 to 499 grams. However, probation of the accused will not be allowed in such instances.

No plea bargaining is allowed in the following instances:

A. Possession of 10 grams or more of”shabu.”

B. Possession of 500 grams or more of marijuana.

C. Sale of “shabu” exclusively, with a quantity of 1.00 gram or more.

D. Sale of marijuana exclusively, with a quantity of 10 grams or more.

E. Sale of all other kinds of dangerous drugs.

OCA Circular No. 80-2019 and OCA Circular No. 104-2019 were subsequently issued by Court Administrator Jose Midas Marquez on May 30, 2019 and July 5, 2019, respectively, reiterating to all second level courts the strict observance to the said A.M. No. 18-03-16-SC.
